Insurance

Area of Expertise: Insurance

Our specialist team has a wealth of experience in both Lloyd’s and the company markets in resolving insurance disputes, whether in court, arbitration or mediation.

We deal with a broad range of liability claims including product liability, public liability and A&H claims, as well as disputes arising from all risks, property/business interruption and construction policies. We frequently advise on general coverage issues.

In the professional indemnity field, we have been involved in claims concerning a broad range of professionals, including solicitors, underwriting agents at Lloyd’s, brokers, accountants, marine surveyors, barristers, property surveyors, construction professionals and insolvency practitioners.

We have wide-ranging experience of political and war risks insurance disputes. Two cases of market notoriety in which we have acted are Yona v La Réunion Française, a claim resulting from the Liberian Civil War in which we acted for insurers of overseas policyholders, and the successful prosecution on behalf of Kuwait Airways of their claim against Kuwaiti insurers in respect of damage to aircraft caused on the invasion of Kuwait, a case determined by the House of Lords.

The firm has been involved in handling many public inquiries and inquests, an area of our practice which presents unique problems being fact-finding in nature and yet often the precursor to litigation. Major inquiries in which we have been involved include the public inquiry into the loss of the MV Derbyshire, the Bexley train derailment and the Ladbroke Grove rail disaster and the loss of the Prestige oil tanker off the Spanish coast.
